MLTN Infoline – November 16, 2022
Recap of State Elections
More than a third of the names have changed, but the results of last week’s election largely mean status quo in Augusta. Incumbent Democratic Governor Janet Mills easily won re-election against former two-term Republican Governor Paul LePage. In the legislature, Democrats (and two independent legislators that caucus with them) will fill 84 seats in the House and 22 in the Senate; Republicans won 67 and 13 districts, respectively. This is the same partisan composition that occurred during the 2020 election. However, there will be some new faces in legislative leadership positions. Senate Democrats will be recommending Troy Jackson (D-Aroostook) as President once again, while House Democrats are expected to choose Rachel Talbot Ross (D-Portland) as Speaker of their chamber. Maine Republicans have chosen Senator Trey Stewart (R-Aroostook) and Representative Billy Bob Faulkingham (R-Winter Harbor) as minority leaders. The legislative session begins on December 7. As always, we’ll keep you informed about proposed bills that may impact your organizations. If you have any questions, don’t hesitate to reach out to MCHT’s Public Policy Manager Jeff Romano any time. We’re watching out for your interests in Augusta, Whit, Jeff, and Donna

New MLCAN Model Boilerplate Conservation Easement Template
The members of the Maine Land Conservation Attorneys Network (MLCAN) meet regularly and, among other things, collaborate on a model boilerplate conservation easement template. The group has made a change to the template recently, which pertains to discretionary approvals and amendments. You can download a copy of the new template on the MLTN website. Visit the Publications & Documents page and scroll down to the Land Protection section. Land trusts should use the model boilerplate template only as a guide, customize each conservation easement to its unique circumstances, and seek professional legal assistance.

Did You Know? Maine Land Trust Census
Every five years, MCHT’s Land Trust Program conducts a census of MLTN members. Our goal is to take stock of the progress made by Maine land trusts over the years and better understand the ways they contribute to the state as a whole and in their communities. The last census was fielded in 2019. You can read a summary of the findings on our website here.
