The U.S. Treasury has issued new regulations that significantly affect land trusts involved in easement or land donations from pass-through entities, such as partnerships or limited liability companies. These regulations are complex and subject to further interpretation, but the main point is that land trusts may need to report and disclose information to the IRS about these donations if they are considered a “material advisor.” Failure to comply with this requirement could result in a penalty of $200,000. This introduces a potentially new financial liability for land trusts.
